Terms of Service
DrishtiOps · operated by SSN TechSphere · effective 1 September 2026
These terms are a contract between you and SSN TechSphere (“we”, “us”) for the use of the DrishtiOps mobile application, web console and related services (the “Service”). By creating an account, accepting an invitation, or using the Service you agree to them. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.
1. What the Service is
DrishtiOps records field work on construction and industrial sites: tasks, attendance, completion photographs, procurement requests, escalations, notices and messages. It produces tamper-evident records and, on request, an Evidence Pack for a task, site or date range. It is a record-keeping tool. It is not a safety management system, a permit-to-work system, a payroll system or a source of legal advice. See the Disclaimer.
2. Organisations, roles and accounts
- An Organisation is created by its first user, who becomes its owner. The owner and the managers they appoint control who joins, what roles they hold and what each site records.
- Every account belongs to one person. Do not share credentials. A supervisor may operate a shared “crew device” on behalf of workers who have no smartphone; in that case the record shows who pressed the button and whose attendance it is, and both are responsible for its accuracy.
- Workers sign in with an employee number and PIN, or with an email and password. Keep the PIN private. If a device is lost, revoke it from your profile or ask a manager to.
- You must be at least 18 to hold an account. The Service refuses to enrol anyone under 18 and this cannot be overridden by an organisation.
- External roles (observer, inspector, auditor) receive time-limited, read-only grants to specific sites. A grant ends on its expiry date or when the organisation revokes it, whichever is first.
3. Your organisation’s responsibilities
The organisation that enrols workers is their employer or principal and is the data fiduciary for their personal data under the Digital Personal Data Protection Act 2023. We process that data on the organisation’s instructions as described in the Privacy Policy. The organisation must:
- enrol only people it is entitled to enrol, with accurate names, dates of birth and phone numbers;
- show workers the in-app privacy notice and answer their questions about it;
- use attendance, location and photograph records only for the purposes stated in the Privacy Policy;
- keep its own statutory registers and comply with the laws that apply to its sites, whether or not DrishtiOps records them;
- configure geofences, retention periods and notification settings appropriately for each site;
- grant external access only to people it has verified and only for as long as needed.
4. Acceptable use
You must not:
- submit a photograph, attendance record, location or time that you know to be false, or alter evidence after capture;
- attempt to change, delete or reorder audit records, hash chains or published anchors;
- use another person’s account, PIN or device, or enrol a person without their knowledge;
- access data of an organisation or site you have not been granted access to, or probe the Service for such access;
- use the Service to harass, threaten or surveil a person beyond what their work legitimately requires;
- reverse engineer, scrape, overload or interfere with the Service, or resell it without our written agreement.
We may suspend an account or an organisation that breaches these terms. Suspension blocks access to the Service; it does not delete records, because the organisation’s registers must be preserved regardless.
5. Evidence, records and retention
- Audit records are append-only. Corrections are recorded as new entries; nothing is edited in place. Do not ask us to edit history and do not expect us to.
- Attendance registers, task audit trails and dispute records are kept for five years because the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Central Rules 1998 require it. Organisations cannot shorten or extend that period.
- Photographs and voice notes are kept for up to five years from task close. An organisation may set a shorter period. Nothing is kept indefinitely.
- A legal hold placed by a manager preserves specific records beyond their retention period. Only an owner can release it. Every hold and release is recorded.
- Evidence Packs are produced from the records as they stand. We do not warrant that a pack meets the evidentiary rules of any particular court or tribunal. The certificate template included in a pack is a draft until your organisation has had it reviewed.
6. Availability, offline use and notifications
- The mobile app is designed to work without signal. Actions taken offline are queued on the device and sent when a connection returns. Until then they exist only on that device. A lost or wiped device loses anything not yet sent.
- Push notifications are delivered by Google’s Firebase Cloud Messaging and may be delayed or dropped by the handset manufacturer’s battery settings. Do not rely on a push notification for anything time-critical; use the app’s task list and, where configured, SMS.
- We aim for continuous availability but do not guarantee it. We may change, suspend or withdraw features with reasonable notice, and without notice where necessary for security.
7. Fees
During the beta the Service is provided on the terms agreed with your organisation in writing, which may include a free period. Where fees apply they are set out in your organisation’s order form or subscription and are payable in advance. If a subscription lapses the organisation may be suspended; its records are retained for the statutory period regardless.
8. Intellectual property
We own the Service and its software. Your organisation owns the records it creates in the Service, including photographs, and grants us the licence needed to store, process, back up and return them. Workers retain the rights the law gives them in their own personal data. You may not remove any notice of ours from an export.
9. Warranties and limitation of liability
The Service is provided “as is” during the beta. To the extent permitted by law we exclude all implied warranties, including fitness for a particular purpose. We are not liable for loss of profit, revenue, contracts or data, or for any indirect or consequential loss, or for any loss arising from a decision taken in reliance on a translation, a location verdict, a notification, or an Evidence Pack. Our total liability to an organisation in any twelve-month period is limited to the fees it paid us in that period, or ₹10,000 if none. Nothing in these terms limits liability for fraud, death or personal injury caused by our negligence, or anything else that cannot be limited by law.
10. Indemnity
Your organisation will indemnify us against claims arising from its breach of section 3 or 4, including claims by its workers that it enrolled or monitored them unlawfully.
11. Termination and account deletion
- Any user can delete their own account from the app at any time. What is deleted and what is retained is set out in the Privacy Policy.
- An organisation may close its account by written notice. We will return its records on request within 30 days and then delete what the law does not require us to keep.
- We may terminate for material breach not remedied within 14 days of notice, or immediately for a breach of section 4.
12. Changes to these terms
We may update these terms. Material changes will be notified in the app or by email to organisation owners at least 14 days before they take effect. Continued use after that date is acceptance.
13. Governing law and disputes
These terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts at [city], India, after a good-faith attempt to resolve them by discussion between senior representatives for 30 days.
